A Cass County family is pushing to redraw district boundaries so their children can permanently attend West Fargo schools, setting up a clash between local districts over tax bases and student enrollment. The petition, which targets a Horace residence on 46th Street Southeast, has already cleared its first major hurdle with the receiving school board despite hitting a definitive brick wall elsewhere.
According to reports from InForum, the West Fargo Public Schools Board voted unanimously on October 26, 2026, to approve the annexation petition. However, the property currently sits squarely within the Kindred School District, whose own board reviewed and unanimously rejected the family’s request on October 12, 2026.
How the Annexation Battle Unfolded Across District Lines
The formal boundary change request was filed under North Dakota Century Code chapter 15.1-12, according to reporting from Valley News Live. The paperwork outlines a proposed transfer involving land situated within Section 27, Township 138 North, Range 50 West of the Fifth Principal Meridian, with at least two-thirds of the qualified electors residing on the property signing the request on September 28, 2026.
North Dakota law requires petitioners to prove that at least one child living on the land plans to attend public school in the receiving district during the year following the annexation’s effective date. The petitioning family meets this criterion, having already moved their children from Kindred to West Fargo Public Schools through open enrollment. Yet, while open enrollment grants temporary access, it remains precarious. Heather Leas, West Fargo’s director of health, safety and public relations, noted that open enrollment is evaluated annually based on building capacity and can be revoked at any time. Annexation offers permanent status.
Kindred Superintendent Mike Kolness explained the stakes from his district’s perspective. While declining to speak for the board that issued the rejection, Kolness pointed out the broader financial implications of losing taxable property.
“When you start moving property from one district to another, it impacts the valuations in your district, and eventually could impact finances as well.”
Kolness said.
The Road Ahead to the December County Hearing
With West Fargo’s approval secured, the petition now advances to a county committee hearing scheduled for 1 p.m. on December 2, 2026, at the commission chambers located at 211 Ninth St. S. in Fargo. The Cass County Finance Office indicated that public notice details regarding the hearing will appear in The Forum on November 4, 2026.

If the county committee signs off on the boundary shift, the final review and decision will fall to the State Board of Public School Education. For West Fargo officials, the financial benefit of adding the parcel to their local tax base was part of the board’s initial October discussion. Leas, who has served the district for nearly two decades, noted that this marks her first encounter with a residential annexation request, following a purely agricultural property exchange with Mapleton Public School District last year that involved no students.
Whether the State Board will override Kindred’s unanimous rejection to grant this family permanent placement remains entirely dependent on the upcoming county and state evaluations.
