Club Med Manager Granted Bail After Rape Accusations in KwaZulu-Natal

A 35-year-old beach resort manager in KwaZulu-Natal has been granted R5,000 bail after being accused of raping and sexually assaulting an 18-year-old tourist from Lebanon. While state authorities allege the teenager was incapacitated by alcohol, the French national insists the encounter in his staff flat was entirely consensual.

Arrest and Court Proceedings at KwaDukuza Magistrate’s Court

The legal proceedings unfolded over a three-day bail application in the KwaDukuza Magistrate’s Court, culminating in the release of the 35-year-old French national on Tuesday. The accused, who cannot be named until he has formally pleaded to the charges, faces one count of rape and one count of sexual assault. The alleged offenses took place on July 22 at Club Med Tinley Manor, less than three weeks after the R2.1bn resort opened its doors on July 4.

When the manager first appeared in court on July 24 following his arrest on July 23, he did not have a lawyer and requested both Legal Aid and a French interpreter, though an interpreter was not immediately available. By the time of the bail hearing, he was represented by attorney Anand Nepaul. The court granted bail under strict conditions: the accused must surrender his French passport, reside at a Salt Rock guest house for the duration of the proceedings, report to the Umhlali police station every Monday, avoid contact with state witnesses, and remain in the country.

State Allegations and Police Affidavit Details

According to the state’s case presented through court documents, the 18-year-old victim came to South Africa for a family holiday with his parents, which included a safari before heading to the beach resort. Investigators assert that the teenager had been drinking with the resort manager, who invited the young guest to his staff flat located 300 meters away from the room where the teenager’s parents were sleeping.

The state charge sheet details that the manager unlawfully and intentional committed an act of sexual penetration by inserting the complainant’s genital organ into his mouth, and committed sexual assault by removing his pants and fondling his genital organ. Prosecutors contend that the teenager was given enough alcohol to become paralysed and unable to stop the assault.

Investigating officer Sergeant Sanele Patrick Gama, a 20-year veteran of the police service, noted in his affidavit opposing bail that nearly a month after the incident, the young man still cannot bring himself to speak about that night. The state intends to introduce video footage as evidence during the trial.

The Accused Manager’s Counter-Affidavit

In a 61-paragraph bail affidavit, the accused French national offers a sharply contrasting timeline of the events leading up to the encounter. He states that he first met the teenager at the resort’s main bar around 10 pm on July 19, when he noticed the young man sitting alone at a table and invited him to join a group of about 10 guests and staff members.

According to the manager’s statement, the teenager later mentioned he was on a short holiday with his family and voluntarily shared his Instagram handle and WhatsApp number. The affidavit notes that when the boy mentioned he was not on good terms with his girlfriend back home, the manager replied, That’s why I am gay! Three days later, the teenager and his parents visited the boutique where the manager worked, fresh off a safari trip where they reported seeing giraffes.

The accused states that on the night of July 22, he performed a choreographed dance routine on the stage while working at the bar. While I was dancing on the stage, the complainant was looking at me intensely and in a seductive manner while remaining seated at the table, the manager’s affidavit claims. After the bar closed at midnight, the teenager allegedly asked for extra drinks and cigarettes, prompting the invitation to the manager’s apartment.

Consensual Encounter Claims and Ongoing Legal Status

Once inside the staff flat, the manager maintains that the teenager called his girlfriend to inform her he was spending time with the accused before steering the conversation toward sex. The affidavit states that the young guest pulled down his own pants, lay on the bed, and asked for oral sex.

Partey granted bail on rape charges

The manager stated that he is openly gay, explaining that he mentioned this to the teenager during their first meeting.

The manager’s account asserts that when the teenager subsequently asked him to stop because of his girlfriend, he complied immediately. The young man then dressed and left the apartment at approximately 3 am. The accused claims he followed up with a WhatsApp message asking why the teenager had departed, to which he replied: ‘I’ll meet you in London’ and then cut the call.

The French national intends to plead not guilty to the charges as the case proceeds through the South African judicial system.
