Late-night talk show host Jimmy Kimmel announced that his scheduled interview with Democratic Senate candidate James Talarico will air on YouTube instead of the traditional ABC network broadcast, citing threats from the Federal Communications Commission.

During his Wednesday monologue on Jimmy Kimmel Live, Kimmel stated that the decision was made out of consideration for local stations and Texas ABC affiliates. The Texas Senate race features Talarico running against Republican Attorney General Ken Paxton in an election that could determine control of the U.S. Senate. Kimmel noted that his program had spent more than 20 years interviewing political candidates without encountering regulatory obstacles.

FCC Equal-Time Rules and Regulatory Scrutiny

The broadcast bypass comes amid heightened regulatory pressure from the FCC. In January, the Republican-led agency ruled that daytime and late-night television talk shows are no longer considered “bona fide” news programs, removing their traditional exemption from equal-time rules that require networks to provide comparable airtime to opposing political candidates.

The shift follows a similar incident in February, when former CBS late-night host Stephen Colbert stated that network lawyers barred him from airing an interview with Talarico on television (according to the Los Angeles Times). That interview was moved to YouTube, where it accumulated more than 9.5 million views. Additionally, the FCC launched an investigation into the ABC daytime talk show “The View” following a Talarico appearance in January, prompting Disney to state that the program has not hosted any political candidates since February due to the agency’s pressure campaign.

Disney Legal Battles and Station License Reviews

The tensions between the network and federal regulators escalated significantly earlier this year. In April, FCC Chairman Brendan Carr ordered early reviews of the broadcast licenses for eight ABC stations owned by The Walt Disney Co., even though standard renewals were not scheduled until late 2028 or 2030. According to regulatory records, the FCC had not ordered an early license review in more than 50 years prior to April’s directive.

The early reviews were ordered a day after President Donald Trump publicly urged ABC to fire Kimmel following a joke the comedian made about First Lady Melania Trump. In August, Disney filed a lawsuit in federal court seeking to block the early station reviews, arguing that the administration was attempting to punish the network over its programming and content in violation of First Amendment protections.

Political Reactions and Concerns Over Government Interference

The decision by Kimmel drew sharp criticism of the regulatory agency from within the government itself. Anna Gomez, the sole Democrat on the Commission, released a social media statement condemning what she described as an ongoing campaign of censorship and control. Gomez stated that Kimmel’s choice to keep the interview off the public airwaves demonstrates the extent of federal intimidation and expressed hope that the courts will clarify that the FCC holds no authority to dictate editorial choices or viewer access.

Critics have warned that while broadcast license revocations remain extremely rare, the threat of losing a license for using public airwaves places undue pressure on networks and raises serious concerns regarding government interference in programming decisions. ABC declined to comment on the matter, and the FCC did not immediately respond to requests for comment.
