Arizona Voters Pass Proposition 318 to Restrict Transgender Student Sports

Arizona voters approve Proposition 318 to restrict sports and facility access for trans students

Arizona voters have finalized a decision on the participation of transgender students in school athletics and their access to campus facilities. According to a projection by Decision Desk HQ early Wednesday morning, Proposition 318—formally titled the “Protect Girls’ Sports in Arizona Act”—secured approval with 59 percent of the vote. With 79 percent of ballots counted by 3:39 a.m. Eastern time, the measure will take effect on January 1.

The new law establishes a rigid framework for school athletic departments and facility management. It mandates that participation in sports teams and access to locker rooms, showers, and restrooms must align with an individual’s sex as recorded on their original birth certificate. By defining sex strictly as “biological status as male or female as recorded at birth,” the proposition effectively removes the existing flexibility that previously allowed students to join intramural teams designated for the opposite sex.

Expanding the scope of the 2022 law

This mandate builds upon legislation originally signed by Governor Doug Ducey in 2022, which had already prohibited transgender girls from participating on girls’ sports teams in both public and private schools that compete against them. While that earlier law encountered significant legal hurdles, it was ultimately enacted earlier this year following a Supreme Court ruling. Proposition 318 broadens these existing restrictions, applying them across all Arizona schools and athletic associations while empowering students to pursue civil litigation against schools that fail to comply with these rules.

Supporters of the measure framed it as an issue of fairness and safety. However, the policy has drawn sharp criticism from civil rights advocates who warn of the effects on student life beyond the playing field.

You are in danger of facilities or cities reading the law very broadly and restricting access to bathrooms for trans kids and adults in a variety of situations which have nothing to do with participation in sports.… It can really act as a big barrier for trans people to participate in public life, said Darrell Hill, policy director for the ACLU of Arizona.

The political context of the midterms

The passage of Proposition 318 arrives during a cycle of state-level ballot measures targeting LGBTQ+ youth. According to data from GLAAD, there were five such measures on state ballots during this cycle. Republicans, faced with an unpopular president and headwinds from issues like affordability and the war in Iran, tried to use anti-trans campaigning to turn out their base for the midterm elections.

For parents, school administrators, and students in Arizona, the practical implications of this vote will begin to manifest when the law goes into effect on January 1. The legal disputes surrounding this measure remain a point of contention, with critics like Hill noting that the extension of these restrictions into private schools may invite further scrutiny regarding potential First Amendment violations.
